Taking a taxpayerโ€™s property for unpaid tax is referred to as a โ€œseizure.โ€ To ensure that taxpayersโ€™ rights are protected, specific rules apply to many aspects of the seizure process-from taxpayer notification through sale or redemption of the property.

The study determined that in recent years seizures have decreased by 58 percent from 776 in Fiscal Year 2011 to 323 in Fiscal Year 2017.

However, the study detected instances in which the IRS did not comply with a particular Internal Revenue Code section, an internal procedure, or there was no guidance at all. This resulted in violations of taxpayersโ€™ rights and taxpayer burden. Errors identified were related to Collection Due Process rights, non-judicial sale notices, and property valuations.
